bavivi is a company offering a wide range of modern, fully serviced co-living spaces designed for young professionals and expats. Rooms can be rented quickly and easily via the company website www.bavivi.com. To access certain functionalities of this website and utilize special services, you need to register as a member of the "bavivi Community."

1. Acceptance of Terms

By registering for and/or using the services in any manner, including but not limited to visiting or browsing the website, you agree to these Terms of Service and all other operating rules, policies, and procedures that may be published from time to time on the website by bavivi, each of which is incorporated by reference and may be updated without notice.

Certain services may be subject to additional terms and conditions specified by bavivi. The use of such services is subject to those additional terms and conditions, which are incorporated into these Terms of Service by this reference.

These Terms of Service apply to all users of the services, including, without limitation, users who are contributors of content, information, and other materials or services, registered or otherwise.

2. Member Registration

The offering of bavivi, including but not limited to the rental of a room, is available exclusively to registered members. To access the facilities offered by the "bavivi Community," you must successfully apply to the "bavivi Community."

Membership is available only to individuals of full age (18 years or older) and with full legal capacity. By registering with bavivi, you declare that you are at least 18 years old and possess full legal capacity.

bavivi may, at its sole discretion, refuse to offer the services to any person or entity and change its eligibility criteria at any time.

The right to access the services is revoked where these Terms of Service, or use of the services, is prohibited or conflicts with any applicable law, rule, or regulation. Further, the services are offered only for personal use and not for the benefit of any third party.

3. Registration

To register, you must provide the following:

• Personal details
• Answers to questions about yourself
• Means of payment (if required for optional services)

If you are already registered as a bavivi member, your personal data will be confirmed (on a random sample basis), either online or in person, by a bavivi representative.

bavivi reserves the right to reject or accept registration requests at its discretion. Users have no claim to registration. If your registration request is accepted, you can review your registration details and accept the terms of membership in bavivi.

Membership authorizations are granted exclusively to registered users and are non-transferable. Only one active member account per user is allowed.

You represent that the information provided during registration is accurate, complete, and up-to-date and will be updated on an ongoing basis as needed. Users are responsible for keeping their account password secure and notifying bavivi immediately of any changes in eligibility to use the services, breaches of security, or unauthorized account use.

4. Content

"Content" includes, without limitation, information, data, text, photographs, videos, audio clips, written posts, comments, software, scripts, graphics, and interactive features provided or made accessible through the services.

You acknowledge that all content accessed through the services is at your own risk. bavivi does not guarantee that any content will be accurate, complete, or available.

Content provided by bavivi, its partners, or its users is protected by copyrights, trademarks, and other proprietary rights. Subject to these Terms of Service, bavivi grants each user a worldwide, non-exclusive, non-transferable license to use the content solely for personal purposes.

You shall not reproduce, modify, distribute, or store any content for purposes other than using the services without prior written permission from bavivi.

5. Rules of Conduct

Users agree not to use the services for any unlawful or prohibited purpose. This includes but is not limited to:

• Violating intellectual property rights or any applicable laws.
• Posting false, misleading, or inappropriate content.
• Uploading content containing viruses or harmful software.
• Engaging in spamming or unauthorized advertising.
• Attempting to bypass security measures or interfering with the operation of the services.

6. Payment Terms

Membership in the "bavivi Community" is free of charge. However, certain optional services may require payment.

7. Start and End of Membership

Membership in the "bavivi Community" begins at the time of rental and ends automatically with the termination of the rental agreement.

8. Extraordinary Termination of Membership

bavivi may terminate your membership unilaterally and extraordinarily if you violate these Terms of Service. Examples of serious violations include:

• Violating the rules of conduct in Section 5.
• Providing false, outdated, or incomplete information.
• Creating multiple accounts.

9. Liability Limitations

bavivi accepts no liability for damages arising from the direct or indirect use of the website, except for cases of intentional acts, gross negligence, or injury to life, limb, or health as mandated by law.

Users are solely responsible for their interactions with others through the services. bavivi does not guarantee compatibility between members or safety during personal interactions.

10. Right of Withdrawal

If you are a consumer under Swiss law, you have the right to withdraw from membership within 14 days of registration. To exercise this right, inform bavivi at the following contact details:

Upon withdrawal, any payments made will be refunded within 14 days, except for services already provided.
